Texas SB 1264 sends out-of-network balance-billing disputes on state-regulated Texas plans to mediation or arbitration through the Texas Department of Insurance. The arbitrator's fee is split half/half between the parties per case, and each arbitrator publishes a fixed fee on TDI's public roster: $450 minimum, $1,000 median, $2,500 maximum across 174 arbitrators (TDI roster, fetched 2026-08-30; TDI Balance Billing Biennial Report, Nov 2024). How Arbitrator Selection Works Under SB 1264

Selection is party-strike, not regulator-pick: if the parties don't jointly agree on an arbitrator, TDI's portal offers five names, each side may strike up to two, and on day 31 TDI assigns by rotation from the survivors (Tex. Ins. Code §1467.086; 28 TAC §21.5021; TDI IDR process FAQ). Joint agreement is vanishingly rare — 7 of 326,803 requests in 2024 (TDI biennial report, Nov 2024).

What This Table Will Never Tell You

No per-arbitrator decision or award data is public for this venue, and none is claimed or implied here. Unlike the federal No Surprises Act IDR process, TDI publishes nothing connecting an arbitrator's name to any decision — there is no public basis for saying one Texas arbitrator decides differently than another. The fee is the only quantifiable, publicly-sourced strike signal, so the fee is all this table contains.
